OFFICIAL CONTEST RULES AND CONDITIONS

 

CONTEST LOCATION: Silver Street Studios at Sawyer Yards, 2000 Edwards Street Houston, TX 77007, 11 a.m. CT – 3 p.m. CT (in-person only)

ENTRANT:  Limited to children between the ages of 5 and 12 years.

By entering Entrant into this this Casting Call Contest (the “Contest”), Parent or Legal Guardian, on behalf of themselves and Entrant, is deemed to have read, understand and agreed to these OFFICIAL CONTEST RULES AND CONDITIONS (the “Rules and Conditions”)

NO PURCHASE OR PAYMENT NECESSARY TO ENTER OR BE CHOSEN. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF BEING CHOSEN. VOID WHERE PROHIBITED BY LAW OR REGULATION.

ENTRANT MUST BE A FULL TIME RESIDENT OF ONE OF THE FOLLOWING HOUSTON-THE WOODLANDS-SUGAR LAND METROPOLITAN STATISTICAL AREAS: (The counties of Austin, Brazoria, Chambers, Fort Bend, Galveston, Harris, Liberty, Montgomery and Waller) Collectively (the “Participating Markets”) AT THE TIME OF ENTRY.

Use of Data. Sponsor will be collecting personal data about Entrant online, and/or in person in accordance with Sponsor’s privacy policies. Please review Sponsor’s privacy policy at. By participating in the contest, Parent/Guardian, on behalf of Entrant, hereby agrees to Sponsor’s collection and usage of their and Entrant’s personal information and acknowledges that they have read and accepted Sponsor’s privacy policy.

CONTEST TIMING:

The pre-registration period for the Contest begins on Monday, May 9, 2022. You may also register in person on the day of the Contest on May 21, 2022 (see Contest location and time  above).  Each eligible Entrant will be judged based on predefined criteria as later described in these Rules and Conditions to determine the winning Entrant  to have the honorary title of “Chief Humankindness Officer” for St. Luke Health. This title will be for a limited period of time only.

Entry in this Contest does not constitute entry into any other promotion, contest or sweepstakes. By participating in the Contest, each entrant unconditionally accepts and agrees to comply with and abide by these Rules and Conditions  and the decisions of St. Luke’s Health System Corporation dba CHI St. Luke’s Health (TX) with an address at  6624 Fannin, Suite 1100 Houston, TX 77030 (the “Sponsor” and “Judge”) and the rules administrator COHEN-FRIEDBERG ASSOCIATES, LLC Framingham, MA 01702 www.cfapromo.com (the “Administrator”) whose decisions shall be final and legally binding in all respects.

ELIGIBILITY:

This Contest is open to all residents of the Participating Markets only, who are not younger than age 5 or older than age 12 on the date of May 21, 2022, and must have their parents’/legal guardians’ permission to participate in the Contest.  Permission occurs when the Parent or Legal Guardian has signed the Talent Release Form, which will be provided on the day of the Contest. Employees, officers, and directors of Sponsor, Administrator, Allison+Partners, Contest suppliers, and each of their affiliated companies, subsidiaries, licensees, franchisees, distributors, dealers, sales representatives, their advertising and Sweepstakes agencies, and any and all other companies associated with the Contest (collectively, the “Contest Entities”), and each of their immediate family members and/or people living in the same household are not eligible to participate. All eligibility is subject to all federal, state, and local laws and regulations. All entries submitted are the property of the Sponsor.

HOW TO ENTER:

Contest Objectives: St. Luke’s Health (part of CommonSpirit Health) in the Participating Markets, will hold a casting call search for a Chief Humankindness Officer. The Chief Humankindness Officer is an honorary role for a child that will help cultivate and share words of encouragement and empathy on behalf of St. Luke’s Health and its Hello humankindess movement. Harnessing the power of words and encouragement, the market activation will underscore how kindness and empathy towards others can impact our overall health.

The talent search will include a one-day open casting call featuring kids ages 5-12 and their best “words of motivational encouragement”. Entrants will be asked to deliver no more than (30) seconds of original motivational encouragement i.e., What does humankindness mean to you and how do you show humankindness to others? How would you cheer someone up or encourage them to tackle a challenge? What motivational words would you say to put a smile on someone’s face?   All Entrants will be video recorded (“Eligible Video”).

At the conclusion of the Casting Call, executives, as determined by the Sponsor in its absolute sole discretion, from the Sponsor will review the Eligible Videos, to determine one (1) winner. In case of a tie, a third party will be selected by the Sponsor, in its absolute sole discretion, to judge the tied Entries to determine the winner.

 

Only the person registered to participate in the Casting Call will be eligible for the Casting Call opportunity.

Parent or legal guardian to follow these steps to enter:

  1. You may either pre-register your child online at org/cho or do so in person on the day of the Contest. Complete all the required information on the registration form.
  2. On the date of the event, sign a talent release form.
  3. Once your child’s registration is reviewed and approved by a Sponsor representative, your child will be allowed to perform and participate in the Casting Call.
  4. HINT: Be sure to have your child’s :30 second words of motivation presentation rehearsed in advance.
  5. All presentations must be in English.
  6. Parent or legal guardian be present at all times during the live, in-person, one- on- one Casting Call.

Once Sponsor or Administrator chooses to close the registration period on the date of the Content, no additional entries will be accepted for any reason.  The Sponsor’s database clock will be the clock for this Contest.

All entries are subject to verification and approval by the Sponsor. Entrants who do not meet the requirements for the Contest  or otherwise do not comply with the Rules and Conditions may be disqualified. Any attempted form of entry other than as described herein is void. Sponsor will determine in its sole discretion, what constitutes an eligible entry.

Sponsor reserves the right to cancel or modify the Contest if fraud or technical failures impair the integrity of the Contest as determined by the Sponsor, in its sole discretion, and to limit participation based on eligible entries received prior to the cancellation.

Casting Call Recording Video: Participants “words of motivational encouragement” should not exceed (30) seconds in duration and may not include any people other than Entrant.

Entry Notes: Only one casting or presentation per Entrant. Once any presentation video is made, Entrant cannot access/revise such entry in any way. No presentation, or description may be obscene, pornographic, violent, cruel, mean spirited, offensive in any manner, have swear words, or in any other way not suitable to be published. If an entry falls into this category, it may become void in the sole discretion of the Sponsor.  Tampering with the entry process or the operation of the Contest is prohibited. Any entries deemed by Sponsor, in their sole discretion, to have been submitted in this manner will be void. In the event a dispute regarding the identity of the individual who actually submitted an entry cannot be resolved to Sponsor’s satisfaction, the affected entry may be deemed ineligible. By entering, parent or legal guardian, on behalf of themselves and Entrants release the Sponsor and Administrator from and against all claims and damages arising out of or in connection with each Entrant’s participation and/or entry in the Contest and/or his/her receipt or use of any opportunities or awards in the Contest.

JUDGING CRITERIA: All Eligible Entries will be judged based on the following weighted criteria:

  • Creativity
  • Adherence to the Contest theme (Hello humankindness®)
  • Originality
  • Entrant’s presence, likability, and personality.

OPPORTUNITY PRIZE:

The winner will be designated with the honorary title of “Chief Humankindness Officer” for St. Luke’s Health for a limited period of time determined by St. Luke’s Health.

Should the opportunity arise, as determined by St. Luke’s Health, the winner may be invited to participate in its local marketing efforts.

The winner may also have an opportunity to attend a one-on-one session with a local casting director. Director and length of time will be identified and coordinated at the discretion of St. Luke’s Health in its absolute discretion.

WINNER ANNOUNCEMENT:

Selected winner will be contacted by the Sponsor prior to any public announcement. Once the winner has been confirmed, a public announcement will be made. The Contest is conducted under the supervision of the Sponsor and Administrator. The winning Entrant will be notified in person or by phone and/or by email or mail or express mail, whichever is deemed appropriate by the Sponsor, using the contact information provided at the time of registration. Sponsor shall have no liability for any potential winning notification that is lost, intercepted or not received by any potential winner for any reason. If, despite reasonable efforts, any potential winner does not respond within (5) calendar days of the first notification attempt, or if the notification is returned as unclaimed or undeliverable, such potential winner may forfeit his or her chance to be the honorary Chief Humankindness Officer and an alternate winner may be selected. If any potential winner is found to be ineligible, or if he or she has not complied with these Official Rules or declines to participate for any reason prior to award, such potential winner will be disqualified, and an alternate winner may be selected. An alternate winner will be defined as the next entry deemed with the highest score.

INTELLECTUAL PROPERTY RIGHTS:

As a condition of entry, parent or legal guardian, on behalf of themselves and Entrant, hereby grants to Sponsor a perpetual, irrevocable, worldwide, royalty-free, and non-exclusive license to use, publicly display, any recording entry, casting, presentation, and other submission materials that Entrant provides, submits or participates in during the Contest for the purposes of allowing Sponsor to administer the technical and other requirements of the Contest, including distribution of each Entrant’s casting and related information to the Administrator, and to advertise, display, demonstrate, or otherwise promote a copy of Entrant’s casting  video entry. Parent or legal guardian, on behalf of themselves and Entrant, specifically agree that Sponsor shall have the right to use, edit, modify and publicly display a copy of Entrant’s casting in connection with any advertising and promotion of the video via communication to the public or other groups, including, but not limited to the right to make screenshots, animations and video clips available for promotional purposes.

GENERAL RESTRICTIONS/CONDITIONS:

BY ENTERING, PARENT OR LEGAL GUARDIAN AGREE on behalf of themselves and Entrant and for entrant’s heirs, executors, and administrators (A) to release and hold harmless Sponsor and Administrator, and their respective affiliates, parents, owners, franchisees, officers, directors, and employees (collectively, “Released Parties”) from any liability, illness, injury, death, loss, litigation, or damage that may occur, directly or indirectly, whether caused by negligence or not, from Entrant’s participation in the Contest and/or his/her acceptance, possession, use, or misuse of the Contest opportunity or any portion therefor to any video opportunity, including, without limitation, to such quality or fitness for particular purpose; and (B) to be bound by these Rules and Conditions and to waive any right to claim any  ambiguity or error therein or in the Contest itself (C) that Released Parties have neither made nor are in any manner responsible or liable and to be bound by all decisions of the Sponsor, which are binding and final.

PUBLICITY RELEASE:

Participation in the Contest constitutes Entrant’s and his/her parent or legal guardian’s permission for Sponsor to use and have use made of Entrant’s name, photograph, image, likeness, voice, biographical information, statements and address, and submitted entry (collectively, the “Attributes“), for advertising and/or publicity purposes worldwide and in all forms of media now known or hereafter devised, in perpetuity, without further compensation or authorization, (except where prohibited by law), and releases Sponsor  from all claims arising out of the use of such Attributes.

DISQUALIFICATION/FORCE MAJEURE:

In the event of an insufficient number of Entrants or Sponsor is prevented from awarding the opportunity or continuing with the Contest as contemplated herein by any event beyond its control, including but not limited to, fire, flood, natural or man-made epidemic of health of other means, earthquake, explosion, labor dispute or strike, act of God or public enemy, satellite or equipment failure, riot or civil disturbance, terrorist threat or activity, war (declared or undeclared) or any federal state or local government law, order, or regulation, public health crisis (e.g. SARS), pandemic, COVID-19, order of any court or jurisdiction, or other cause not reasonably within Sponsor’s control (each a “Force Majeure” event or occurrence), then Sponsor shall have the right to modify, suspend, or terminate the Contest. If the Contest is terminated before the designated end date and time, Sponsor will (if possible) judge all eligible, non-suspect entries received as of the date of the event, giving rise to the termination. Inclusion in such judging shall be each Entrant’s sole and exclusive remedy under such circumstances. Only the type of opportunity described in these Official Rules will be awarded.

LIMITATION OF LIABILITY:

The Released Parties are not responsible for, and the parent or legal guardian of an Entrant hereby releases the Released Parties from any claims arising from: (i) technical failures of any kind, including but not limited to the malfunctioning of any computer, cable, network, hardware or software; (ii) the unavailability or inaccessibility of any transmissions or telephone or Internet service; (iii) unauthorized human intervention in any part of the entry process or the Contest; (iv) electronic or human error which may occur in the administration of the Contest or the processing of entries; (v) any injury or damage to persons or property, including but not limited to entrant’s computer, hardware or software, which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Contest and (vi) participation in opportunity.

DISPUTES:

Except where prohibited, Entrant agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this Contest or any opportunity awarded shall be resolved individually through arbitration (costs to be shared equally), without resort to any form of class action, and exclusively within the state of Texas, (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Contest, but in no event attorneys’ fees; and (3) unless otherwise prohibited, under no circumstances will Entrant be permitted to obtain awards for, and Entrant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Rules and Conditions, or the rights and obligations of the Entrant and Sponsor in connection with the Contest shall be governed by, and construed in accordance with, the laws of the State of Texas, without giving effect to any choice of law or conflict of law rules (whether of State of Texas or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Texas.
